Paternal Rights Labour Law

Rights or entitlements for fathers.

1. Paid leave of absence following the birth. 2 days or amplified to 4 if the father has to travel to another city. Starting on day of birth if it´s a working day, the following day if it´s not.

2. Paternity leave, currently at 4 weeks, to be taken immediately following the leave for birth, or anytime during the monther´s maternity leave or even following that.

UPDATE 2019

3. ´Lactating´ leave, to be taken by either the mother or the father, half an hour every day until the child has reached the age of 9 months, or taken in bulk.

4. Reduction in working day to take care of the child. Up to 50% of working day, adjusted salary, until the child reached the age of 12.

5. Extended leave to take care of the child, up to three years. For the first year, the employer must keep open his job position, after that, an equivalent post in the same business.

6. Leave in case child needs to be hospitalised. 2 to 4 days, depending on having to travel to another city.

7. Leave in case child is born prematurely and needs to remain hospitalised. One hour per day the child remains in hospital.
