Technical Building Inspections ITE And IEE

National law re Building Evaluation Reports (Informe de la Evaluación de los Edificios) from June 2013, mentions an obligation for owners or groups of owners of ´residencias de vivienda colectiva´ (apartment buildings, generally) to have the above mentioned report drawn up for properties as of the time the properties are 50 years old, within 5 years of that, so before they are 55 years old.

The Evaluation Report should also be drawn up and presented when subsidies from public sources are to be applied for with regards to conservation works, universal access and improving energy efficiency.

And where the Autonomous Legislation requires such report because of the location, age or predominant use of the property.

Where the Autonomous Legislation is stricter or the building has already undergone a ITE, the results of the latter will be included in the IEE.

Included in the evaluation report should be:

  • info on the state of conservation of the property
  • information on universal access of the property, especially with regards to non discrimination of disabled and should contain advice on whether the property is expected to have reasonable adjustments made to comply with regulations to that effect.
  • information on energy efficiency, included in the Energy Certificate

Exempt are properties that have already had a Technical Building Inspection (Inspección Técnica de Edificios ITE) done, regulated by the Autonomous Governments or even local governments (big cities), but as the ITE doen’t include an Energy Certificate, they would have to add that to complete the information required for the Evaluation Report IEE.

As long as the ITE was carried out before the law re obligation of IEE came into force, but is not older than 10 years.

Both Inspection and Evaluation to be carried out by architects or technical architects.

There is a website where all Autonomous Regions, their Regional and even Local Regulations are published, plus a list of towns that are subject to the regulations, arranged by region.

In most areas, the obligation for a ITE is for properties older than 50 years old, in towns of 25.000 or more inhabitants, but in Málaga for instance, it’s for properties older than 20 years!

You can also google for information using keywords ´inspección técnica de edificios´ and the name of your region or town.

When in doubt, ask your local town hall about the obligation to have such a report carried out.
