A Monitorio Court Case or Monitorio Procedure is a quick and agile way to reclaim debts of a monetary nature as all that is needed is a view (read through) by the judge, or to appear before the judge if the debtor opposes the reclamation.
If the debtor does not pay voluntarily, nor appeals the case within the established timeframe, the procedure automatically finalises in a resolution that permits the claimer to proceed with forced execution, during which assets of the debtor can be embargoed up to an amount that equals the debt.
During the last decade it has become the most used civil procedure in the courts.
