How Do I Make an Application for Non Contribution or Disability Pension in Spain

Non Contribution retirement pensions.

UPDATE. The Junta de Andalucia only states as the requisite for residency is that you should have lived for ten years in Spain or any other EU country but that the last two years were consecutive and in Spain.

Murcia, Valencia and other regions are asking for ten years residency in Spain ruling. As the pensions are paid by the regional governments, we are looking into this. At this stage we believe that this should be a national ruling one way or the other.

Finding. The law of the social security translated states that:
Article 167. Beneficiaries.

1. shall be entitled to the pension, in its non-contributory form, people who, having completed sixty-five years of age, income or lack of income in excess of the limits set out in Article 144 level, legally residing in the territory Spanish and have done so for ten years between the age of sixteen and the age of receiving the pension, of which two must be consecutive and immediately prior to the application of the provision.

Suggest that this reads as having resided legally in Spain for ten years since the age of 16 but only the last two years would have had to run consecutively and immediately before the application.

Disability/Invalidity Pension.

The applicant must be 18 years old and less than 65. Requisites. That they must have been legally resident in Spain for five years, two years consecutive before the application and disability 65%.
