Convenio Regulador for INEM

A Convenio Regulador is the spanish term for Divorce Settlement, in this case the part in which the economic responsibilities of both parents with regards to maintenance of children is laid out. INEM/SEPE can ask for it if you are applying for subsidio ´ayuda familiar´ and have to present proof of your ´unidad familiar´ and that you are, in effect, the parent responsible for maintenance of your child or children.

With legally formalised separation or divorce of married couples, the Convenio Regulador will have been ratified by a judge and you can present this document to INEM. In case of separation of non-married couples (either registered as pareja de hecho or not), INEM will ask for a similar Convenio Regulador, either ratified by a judge, or, in case no official separation or divorce proceedings will take place, by a Notary.

Best to ask INEM directly if they want you to provide them with the Convenio because they assume you are not living with the mother of the child(ren), and if so, and none is in place because you haven´t been in a married situation, if they will be satisfied with a Convenio, signed by both partners in front of a Notary, as this will be the least time and money consuming way to obtain one. The alternative would be to go to court to obtain a judge´s signature on the Convenio Regulador.
