Harrassment at work is punishable by law in Spain and as the employer should make sure it doesn´t happen, or take action if it does and it is reported to them, they are liable and punishable as well as the actual harrasser. In Spain known as ´acoso laboral´ or ´mobbing´. It´s important to realise that the harrassed person is the only one that can take action and that the ´burden of proof´ is with the employer/harrasser in case of a denouncement. If the harrassment has led to a ´baja´ from work because of psychological problems for example, please make sure when you visit your GP to mention the cause of your health problems, as this can aid your case.
This website offers info on where and how to report. Several options, both with and without involving the courts. In Spanish.
Options without involving the courts:
If there´s a Convenio in place for your line of work, please consult that for a protocol to follow.
Or you could denounce with the Inspección de Trabajo. Health and Safety Inspection. Procedure and form to use HERE
If you´re not sure what to do or how to do it, we suggest visiting a workers union office to talk it over with one of their advisors. You don´t have to be a member to ask for their help. Big unions in Spain are UGT and CCOO and you can find a listing of their offices on their respective websites.
