Vivienda con Fines Turisticos in Rural Areas Andalucia

Update November 2019. As per a ruling on the 21st of October 2019 by the Spanish Supreme Court the requisite re fixed aircon units in every room has been eliminated.

In an amendment of the law that rules the establishment and registration of Casas Rurales and Viviendas Turisticas, both in rural areas, hidden as an additional clause in a Royal Decree on Campsites in Andalucia, it is now permitted to register viviendas that do not meet the requisites to register as Vivienda Turistica de Alojamento Rural, as Vivienda con Fines Turisticos instead.

You can´t promote your property as a rural one in that case, the renting out will be ruled by the Royal Decree from February 2016, the same one as for residential properties in cities and coastal areas in Andalucia. And thus will have to meet the requisites of ´Licence of First Occupation´ and aircon in all bedrooms plus living room, to name just the most important ones.

The exact clause from the law reads as follows.

Dos. Se añade un tercer apartado al artículo 9:

«3. Podrán constituirse en el medio rural viviendas con fines turísticos cuando el alojamiento no cumpla con los requisitos exigidos a las viviendas turísticas de alojamiento rural. En este caso, no podrán comercializarse como alojamiento rural, y se regirán, en todo caso, por lo dispuesto en el Decreto 28/2016, de 2 de febrero, de las viviendas con fines turísticos, y de modificación del Decreto 194/2010, de 20 de abril, de establecimientos de apartamentos turísticos.»

As said, included in this Royal Decree that has come into force on February 8 this year.
