There has been a fourth ruling against the INSS for rejecting a person with a valid residencia permit for healthcare funded by the state. This time in Madrid, where the resident that was refused free healthcare was assisted by lawyers from NGO Medicos del Mundo. Previous rulings came from the courts in Castilly y León and Cantabria.
But that is not the most important thing to come off that piece, as it turns out that sometimes the INSS does not reject the application per se but tells residents that apply for free healthcare under the ´bajos recursos´ scheme, to go to “extranjería” to have their residency permit re-evaluated. At this point many people do not go, of course.
As far as I know, the INSS does not have the right to do that, if they had that right, they would contact extranjeria themselves, not send people!
The important point is that, at this stage and with so many rulings against them, they are committing or on the verge of committing prevarication, wich is a felony.
So if you are a resident here, I would go and fight with the letter and accompanying documents I have put together.
Remember, no-one will fight for YOUR rights.
