We received a heads-up from our lawyers about the approval of a new concept-law.
The Consejo de Ministros approved the proposal last Friday and it contains a new calculation system to determine the amount of indemnization to pay out to victims of traffic accidents. The present law is from 1995 and has not been revised since.
When this new law will be approved, victims of traffic accidents that have suffered damage and are thus in a position to claim indemnizations, will be better protected and will be able to claim higher indemnizations so they will have more funds to cover the costs of services needed.
UPDATE 19.04.2016: a survey over the first three months of 2016 shows that less, instead of more money has been paid out to victims since the new law has come into force. According to the report this has to do with little awareness with the general public about the reduced window during which a claim can be put forward (72 hrs as of the date/time of the accident) and that a detailed diagnosis from a medical professional must be submitted as well.
