EES Warning: Biometric Data May Be Collected in Error – Know Your Rights

The Entry/Exit System (EES) is now in operation across the Schengen Area, recording the entry and exit of non-EU travellers.

However, if you hold a biometric residence card issued by an EU country, you are not subject to EES registration. You should not be required to provide fingerprints or facial images under this system.

There are already situations where biometric data is being collected in error.
If you are asked to provide this data, you are entitled to question it and clarify that, as a residence card holder, you fall outside the scope of EES.

Border officials may not always apply the rules correctly in practice. If your data is taken regardless, it does not remove your rights.

The handling of your personal data is governed by the General Data Protection Regulation (GDPR), with oversight from authorities such as the European Data Protection Supervisor (EDPS).

Access any personal data recorded about you
Request correction or deletion of data collected unlawfully
Lodge a formal complaint
