If you are aware of facts that could constitute a violation in matters of competence of the ITSS (labour, occupational safety and health, social security, employment, etc.) you can report it to the Labour and Social Security Inspectorate.

Labour infractions are considered the actions and omissions of the responsible persons (natural or legal persons and communities of property) and that are included and sanctioned in the labour regulations.

The infractions are qualified as minor, serious and very serious and are sanctioned on the proposal of the ITSS, after investigation of the appropriate file.

Main services provided by the Labor and Social Security Inspectorate to companies and workers

Surveillance services and requirements for compliance with legal, regulatory and regulatory content of collective agreements.

The scope of these services refer to the following matters:

Work order and trade union relations.

Prevention of occupational risks.

Rules regarding the scope of application, registration, affiliation, registration and deregistration of workers, contribution and collection of social security system contributions.

Rules on obtaining and enjoying benefits from the Social Security system as well as voluntary improvements or other voluntary complementary systems established in collective agreements.

Rules on collaboration in the management of Social Security.

Rules on placement, employment and unemployment protection; emigration, migratory movements and foreign work; occupational and continuing vocational training; temporary employment agencies, placement agencies and integrated employment service plans.

Technical assistance services

Information, assistance and general guidance to companies and workers, on the occasion of the exercise of the inspection function.

Technical assistance to Social Security entities and agencies when requested.

Information, assistance and collaboration with other bodies of the Public Administrations regarding the application of social rules or the monitoring and control of public aid and subsidies.

Preparation of technical-labour reports at the request of the labour judicial bodies.

Arbitration, conciliation and mediation services

In any case, for the performance of ITSS actions there must be acceptance of the parties affected by the labour conflict or strike.

Inspection actions derived from the services provided by the Labour and Social Security Inspectorate

Requirements or warning acts when no direct damage to workers is derived.

Initiation of sanctioning procedures through the extension of Infringement Acts.

Initiation of liquidation procedures for debts to Social Security and concepts of joint collection, through the practice of Settlement Acts.

Initiation of ex officio procedures for the registration of companies, affiliation and registration and deregistration of workers in the corresponding Social Security regime.

Start of procedures for the framing of companies and workers in the corresponding Social Security system.

Proposal to the competent bodies for the suspension or cessation of social benefits if it is verified that they are obtained or enjoyed in non-compliance with the regulations that regulate them.

Proposal to the competent body of the surcharge of economic benefits in case of work accident or occupational disease caused by lack of safety and hygiene measures at work.

Proposal of surcharges or reductions in insurance premiums for work accidents and occupational diseases in the case of companies for their behavior in risk prevention and occupational health.

Order of immediate suspension of work or tasks due to non-compliance with the regulations on the prevention of occupational risks, of serious and imminent risk to safety and health.

Communication to the competent bodies of non-compliances that are verified in the application and destination of aid and subsidies for the promotion of employment, vocational training and social promotion.

Formulation of ex officio demands before the Social Jurisdiction in accordance with the applicable regulations.
