We at CAB Spain have been writing and informing citizens in Spain about the validity or not of the non Spanish EU driving licences. We have received many emails and posts asking for advice and assistance by many who are not sure whether or not they should change or renew these permits and in many casese if a fine has been justified.
The cases that are now coming to our notice are lamentable to say the least. Genuine nonresidents being fined (one fine 500 euros) for not holding a Spanish driving permit. We have been told by the nonresidents that on a couple of occasions law enforcement officers in question have told them that even a nonresident driving a Spanish plated car must apply for a Spanish licence. This is totally incorrect and impossible to comply with. Besides not being legal to change a UK licence in a country where you are not habitually resident, it is impossible to do so. You must be a resident and your details inscribed in the register of foreigners in Spain which includes being on the padron (census).
For almost two years now drivers have been faced with an illegal protocol from the the DGT and enforced by officers, now we now are facing the ridiculous situation of nonresidents not only being fined illegally but told to change their driving licences.
We at CAB Spain are sure that this will continue and more resident and nonresidents alike will continue to be fall into this trap. We want to take steps to pass a message to the DGT and the law enforcement officers and yes including the traffic Guardia Civil. Those police officers who appear to not be aware of the law must be informed and instructed on the protocols relating to driving in Spain. Complaining is no longer enough and we need to take firm action. We are willing to back anyone who has been affected to put forward a denuncia. To do this you must have full details.
We are asking those who are stopped and fined unjustly, to politely ask the officer for his number and station.
I end with a good Spanish expression “basta ya”.
Update 19/03/16 Email received on the 17th. UK resident here on holiday with his family has been fined 200 euros for driving on a UK licence. The driver who was driving his UK plated car was not it appears, also fined for the vehicles status so inconsistency in the fines.
