UK Nationals and their family members who were lawfully residing in Spain Under Union law before the end of the transition period, automatically obtained their new residence status on January 1 2021.

Residing lawfully in Spain requires the resident to hold healthcare either private or public, sufficient funds to cover themselves and their family members, be employed, self employed, those studying must also have sufficient resources and healthcare cover.
The 90 day in 180 day ruling in relation to Spain, does not apply to those who were lawfully residing in Spain before the transition period, and continue to do so thereafter.
